In your letter) you requested that the CoJlJJlission prepare an Environmental Impact Statement and hold hearings concerning the transport of portions of a replaced steam generator from the Surry Nuclear Power Station to Richland, Washington.
Under the proposed project, the U.S. Department of Energy (DOE} or its prime contractor, Battelle Pacific Northwest Laboratories,.will take possession of the steam generator parts at the Surry Station and transport them to Battel le Pacific Northwest Laboratories in Richland, tfashington.
Although the NRC has regulatory authority over licensed activities at the Surry site, the NRC has no regulatory jurisdiction over DOE, except for those activities specified in Section 202 of the Energy Reorganization Act of 1974 and Sections 104 and 105 of the Uranium Mill Tailings Radiation Control Act of 1978. Battelle, as DOE's prime contractor, would also be ex&~pt from NRC licensing requirements. See, e~g., 10 CFR 30.12, 40.11, 50.11

The Vitrginia El.ectric and Power Company (\\JEPCO) will:. pursuant to the provisions of 10 CFR 30.41, 40.51 *and 70.42 of the Commission's regulations!)
transfer possession of the steam generator to DOE or Battelle at the Surry site. DOE or Batte1le wil 1 package *the steam generator and will transport it to Richland. Although the NRC does not require DOE to submit its packaging plans to the MRC for review, the NRC has an understanding with DOE that DOE will not accept licensed material on sites under the jurisdiction of the NRC except in packages whose design has been approved by the NRC.
OOE (through a contractor) has requested an exemption from the u. S. Department of Transportation 1s (DOT) regulations for shipment of the steam generator.
