PENALTY FEE
Dear Mr. Weinberg:
The Nuclear Regulatory Commission (NRC) received your memorandum to federal agency contacts dated March 29, 2018, regarding the distribution of the Agency Disposition Profile. As you stated, an agency will be charged a penalty fee starting FY19 for boxes stored at the Federal Records Center that are past due for accessioning and/or disposition. We understand your position in preparing the National Archives and Records Administration (NARA) for a reduction in paper and focusing on electronic records.
We are requesting that NARA remove the additional storage charges to those boxes that have a litigation hold, as we are required by law to keep those records. There are also circumstances when an agency must change the retention period on a record series and retain records for a longer period. We also request that if an agency has submitted a revision to the dispositions retention period prior to the end of the retention period, the additional charges be waived. As you are aware, it takes approximately 2 years for NARA to approve a disposition schedule; an agency should not have to pay the additional fees during those 2 years.
NRC is actively working to process past due accessioning and disposition records to reduce our holding and storage fees. We appreciate that NARAs communication with the NRC to inform us of upcoming changes so we can be proactive in managing our records.
