REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, PROPOSED LICENSE TRANSFER-HOPE CREEK GENERATING STATION AND SALEM NUCLEAR GENERATING STATION, UNITS 1AND2 (TAC NOS. MA5674, MA5675 AND MA5676)

Dear Mr. Keiser:

By Public Service Electric and Gas Company's (PSE&G's) letter (LR-N99257) dated June 4, 1999, and affidavit dated June 4, 1999, executed by E. C. Simpson, you submitted "Information Submitted In Support of Proposed License Transfer and Conforming Administrative License Amendments (NRC Facility Operating License Nos. DPR-70, DPR-75, and NPF-57),"

(Attachment 1 to letter LR-N99257) and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. A nonproprietary version (Attachment 2 to letter LR-N99257) was submitted for placement in the NRC public document room.

Your affidavit requested that Attachment 1 to letter LR-N99257 be treated as confidential and withheld from public disclosure pursuant to 10 CFR 2.790(a)(4) for the following reason:

Appendices 9, 1 O and 11 of Attachment 1 contain information associated with New Jersey state restructuring legislation and contains commercial and financial information that is privileged and confidential. Other than PSE&G's disclosure as required under 1 O CFR 50.80, the information therein has been held in confidence and not disclosed to the public. Internal distribution of this information has likewise been limited to essential PSE&G personnel.

We have reviewed your application and the supporting information in accordance with the requirements of 1 O CFR 2.790 and, pn the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, Attachment 1 to your letter LR-N99257, dated June 4, 1999, marked as proprietary, will be withheld from public disclosure pursuant to 1 O CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

  • Mr. Harold Withholding from public inspection shall not affect the right, if any, of persons properly and directly.concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
