RELEASE OF PUBLIC SERVICE ELECTBIC AND GAS DOCUMENTS TO THE PUBLIC

Dear Mr. Eliason:

On July 1, 1 996 the NRC forwarded letters to Public Service Electric and Gas Company (PSE&G) and Bruce Hall concluding that apparent vi0lations of 10 CFR 50. 7 and 10 CFR 50.5 occurred since two NRC investigations (1-94-006R and 1-94-053) concluded that Mr.

Hall deliberately harassed, intimidated, and discriminated (Hl&D) against an Onsite Safety Review (OSR) and a Nuclear Safety Review (NSR) Group Engineer. Subsequent to the July 1, 1996 letter, Mr. Hall's attorney, Bill Briggs, forwarded a memorandum in support of Mr.

Hall and his sworn statement. This memorandum also included seven attachments that were relevant to the case. A public predecisional enforcement conference was conducted with the-company for this alleged Hl&D on September 11, 1996. The conference was also transcribed. The information presented from our investigations and their respective attachments, the memorandum in support of Mr. Hall, his sworn statement, the seven attachments, a subsequent September 13, 1996, memorandum, clarifying the content of a September 22, 1993, meeting, as well as the information presented at the conference was used in considering NRC action on this matter.

This letter notifies PSE&G of NRC's intention to place certain PSE&G documents that were considered in our decision in NRC's Public Document Room. Enclosures 1 and 3 contain the transcript of the predecisional enforcement conference and a clarifying memorandum and will be released consistent with 10 CFR 9.15. Enclosure 2 contains the memorandum in support of Mr. Hall, and his sworn statement, and seven attachments listed as Attachment A through Attachment G. Three of these attachments (A,E,& G) contain information that will be withheld from public disclosure since their release would warrant an invasion of personal privacy. The memorandum in support of Mr. Hall and his sworn statement will be released. The four remaining attachments (B,C,D,& Fl which contain information printed on PSE&G letterhead or which contain the PSE&G logo are considered agency records that do not meet any of the withholding exemptions contained in 10 CfR 9.17 and will be placed in the PDR within 30 days of the date of this letter.

If PSE&G believes that any of these four attachments contained in Enclosure 2 should be

'Nithheld from public disclosure because they contain privileged or confidential financial information; then PSE&G should submit an application for withholding accompanied by an affidavit in accordance with 10 CFR 2. 790(b). Any such application should be received within 10 calendar days from the date of this letter.
