PUBLIC DISCLOSURE DETERMINATION REGARDING FINAL INVESTIGATION REPORT
Dear Mr. Eliason:
This is in response to you*r letter of August 21, 1996 requesting that a final investigation report prepared by Public Service Electric and Gas Company (PSE&G), and an undated, PSE&G letter LR-N96415, received December 23, 1996, related to the aforementioned investigation, be withheld from public disclosure pursuant to 10 CFR 2. 790. This investigation report, dated July 26, 1996, and interview transcript, dated June 5, 1996, relates to an independent investigation of issues associated with Salem Licensee Event Report (LER) 272/94-016-00. In an April 16, 1996 letter, the NRC requested this report in order to respond to those issues.
Both letters indicated that the submitted information should be considered exempt from mandatory public disclosure, pursuant to 10 C.F.R. sec. 2. 790(a)(4) and (6), for the following reasons:
- 1.
The report/transcript contains highly sensitive information relating to personnel matters or otherwise confidential information, and discuss in substantial *detail the conduct of performance of named individuals.
- 2.
Release of the information could reasonably be expected to result in an unwarranted invasion of personal privacy, both as to the named individuals whose performance or conduct was discussed in the report, as well as other individuals who were interviewed for the investigation or whose activities were described in the report.
Both letters also indicated that the letters be returned in accordance with Section 2. 790 (c), in the event that the letters could not be exempted from public disclosure.
We have carefully reviewed your request and the information contained in your investigation report and interview transcript in accordance with the requirements of 10 CFR 2.790, and we have decided to return the information to you. However, we request that 1 r-. -
