Salem Nuclear Generating Station Docket Nos. 50-272; 50-311

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $600,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $600,000 will be issued on or about October 16, 1995, to Public Service Electric and Gas Company {PSE&G).

The action is based on several inspections conducted at the_ Salem Nuclear Generating Station and involves six violations, five associated with PSE&G's failures to promptly respond to and correct conditions adverse to quality over an extensive period of time.

Each of these five violations have been assessed a $100,000 ci~il penalty.

The sixth violation involved the licensee's failure to adequately perform a modification on the Salem Unit 2 pressurizer code safety valves, and was assessed a civil penalty of $100,000.

The total civil penalty for this action is $600,000.

The Commission was consulted on this proposed action in SECY-95-246 and the Commission expressed no objection to the proposal in a Staff Requirements Memorandum issued on October 16, 1995 lt should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Telephone Notification of Licensee The State of New Jersey will be notified.

October 16, 1995 October 16, 1995 The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
