April 6, 1995 EN 95-021 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Public Service Electric and Gas Company Salem Nuclear Generating Station Docket Nos. 50-272; 50-311 PROPOSED IMPOSITION OF CIVIL PENALTY - $80,000 (EA 94-239)

This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $80,000 wi11 be issued on or about April 11, 1995, to Public Service Electric and Gas Company (PSE&G).

The action is based on an investigation by the Office of Investigations and consists of a Severity Level II violation for the harassment and intimidation against two PSE&G Safety Review Group engineers by senior managers at the licensee's Salem Nuclear Generating Station.

The harassment and intimidation of the engineers took place over a two month period after the engineers identified safety concerns to the licensee managers.

The civil penalty was mitigated 50% each for the licensee having identified the violation and having taken prompt and comprehensive corrective actions after the violation was identified. The civil penalty was escalated 100% because the then Vice President and Chief Nuclear Officer, as well as the then Vice President, Nuclear Engineering, were aware, soon after the December 3, 1992 initial event, that a confrontation had

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
