April 6, 1995 EN 95-022 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Mr. Calvin Vondra (IA 95-009)

Sub.iect:

NOTICE OF VIOLATION This is to inform the Conunission that a Notice of Violation will be issued on or about April II, 1995, to an unlicensed individual who was the former General Manager-Salem Operations (GM-SO) at the Public Service Electric and Gas Company's Sa*l em Generating Station. The action is based on an investigation conducted by the Office of Investigations and an enforcement conference conducted between the staff and the former GM-SO.

A Severity Level II violation will be issued involving the deliberate harassment and intimidation against two Safety Review Group engineers after the engineers identified safety concerns to the former GM-SO.

A Severity Level II violation* and proposed civil penalty of $80,000 is also being issued to the Public Service Electric and Gas Company, in addition to a Letter of Reprimand being issued to the former Salem Operations Manager, who

It should be noted that the individual has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice Telephone Notification of Licensee and individual April 11, 1995 April 11, 1995 The State of New Jersey will be notified.

The individual is not required to respond to the Notice unless in the future he becomes involved in NRC licensed activities. If he does become involved in such activities, the individual is required to provided a response which includes the reasons as to why the NRC should have confidence that he would not engage in harassment and intimidation in the future.
