REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE-ORGANIZATIONAL EFFECTIVENESS ASSESSMENT REPORT, SALEM GENERATING STATION, UNITS 1 AND 2, DOCKET NOS. 50-272 AND 50-311 By your application dated April 7, 1995, you requested that the Organizational Effectiveness Assessment Report that you voluntarily submitted for NRC review, be withheld, in part, from public disclosure in accordance with 10 CFR 2.790.
In that submittal, you provided a copy of the entire report and a redacted version of the same report.
We understand that you request that the redacted portions of the document be exempt from public inspection.
Your submittal identified the following basis for your request relative to withholding of the redacted portions of the document:

- The information constitutes information contained in personnel-type files and/or files utilized by Public Service Electric and Gas (PSE&G) in making personnel decisions, and as such, would constitute an unwarranted invasion of personal privacy if publicly disclosed.

The information was the result of a critical self-analysis effort undertaken for the purpose of improving corporate (licensee) performance, and was provided to the NRC voluntarily. Disclosure could undermine the important public policy interest in the promotion of candid and unimpeded self-evaluation.

The information in the Executive Summary and the Appendix is of a type customarily held in confidence by PSE&G, and was not intended to be disclosed to the public.
We further understand that if the NRC is unable to grant PSE&G's request for withholding the redacted portions of the report, you request that the documents be returned in accordance with the provisions of 10 CFR 2.790 (c).
Based on our review of your submittal, we agree that the redacted portions of the document should be exempt from public disclosure since: (1) the information was not required to be submitted by the NRC, (2) the information has been customarily treated by you as confidential and would not be normally shared with the public, and (3) the information was voluntarily provided to the NRC with the understanding that it would be treated as confidential.
Accordingly, only the redacted version of the report will be made available to the Public Document Room.

Our decision to withhold the redacted portions of the report from public inspection shall not affect the right of properly authorized individuals to inspect the document, as stipulated in 10 CFR 2.790 (b){6). Further, the NRC may have cause to review this determination in the future, e.g., in the case of a Freedom of Information Act request for the information.
In such case, if the NRC makes a determination different than expressed here, you will be notified in advance and will have an opportunity to request that the document be returned to you, as specified in 10 CFR 2.790 (c).
Please promptly inform the NRC if the basis for withholding this information from public disclosure should change in the future, such that the information could be made available for public inspection. Thank you for your cooperation in this matter.
