PROPOSED IMPOSITION OF CIVIL PENALTY - $500,000 Thi~ is to infor~ the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amdunt of $500,00b will be issued on or about October 5, 1994, to the Public Service Electric & Gas Company.
The action is based on four violations identified by the NRC as a result of an AIT and later followup inspection of plant events on April 7, 1994, including an automatic reactor trip and two automatic actuations of the Safety Injection system.
The violations, three of which are considered to be continuing violations, involve the failure to identify and correct conditions adverse to quality including inadequate procedures and known equipment deficiencies.
Instead of correcting the known problems, the licensee was found to have developed numerous workarounds" which during the event unnecessarily complicated plant transients, challenged safety systems, and impacted operator response. Additionally, both senior reactor operators failed to exercise command and control during the event.
Each of the four violations was characterized as a Severity Level III violation, which has a base civil penalty of $50,000.
Enforcement Discretion was used to increase the proposed civil penalty to $500,000 to emphasize the need for the licensee to promptly identify conditions adverse to quality and to implement effective corrective actions. The ~taff consulted with the Commission on this action in SECY 94-242, and the Commission approved the issuance of the action by SRM dated October 5, 1994.
It should be noted that the licensee has not been specifically informed of the enforcement action.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
