Dear Ms. Schmitt:

We have reviewed the final revisions to the Nebraska regulations to Title 180 NAC 3, 13, and 24, received by our office on March 13, 2018. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2015-1, 2015-2, 2015-3, 2015-4, and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on April 25, 2018.

As a result of our review, we have four comments related to compatibility that have been identified in the enclosure. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Nebraska, in response to our comments, and provide a copy to Division of Materials Safety, Security, State and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Nebraska regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. General license: NRC approved package

a. Nebraska regulations state in 13-007.03, paragraph 2 that the general licensee is a licensee who, Complies with the terms and conditions of the license, certificate, or other approval by the U. S. Nuclear Regulatory Commission (NRC), as applicable, and the applicable requirements of 180 NAC 13.

As written, this can cause confusion to the licensee when deciding which regulation applies.

This can also create duplicate requirements. Nebraska needs to specify which requirements are found in their regulations, and which NRC requirements apply.

b. Nebraska regulations state in 13-007.03, paragraph 3 that prior to first use of an NRC approved package the general licensee should submit documents to the Nebraska Department. The requirement should state that submission of these documents should go to ATTN: Document Control Desk, Director, Division of Spent Fuel Storage and Transportation, Office of Nuclear Material Safety and Safeguards, using an appropriate method listed in § 71.1(a), the licensee's name and license number and the package identification number specified in the package approval.

Nebraska needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 71.17.

General license: Use of foreign approved package Nebraska references 49 CFR 171.12 in 13-010.01. Nebraska needs to revise the reference from 49 CFR 171.12 to 49 CFR 171.23.

Nebraska needs to make the above change to meet the Compatibility Category B designation assigned to 10 CFR 71.21.

Determination of A1 and A2 Nebraska regulations in Appendix 13-A, paragraph IV.d are not essentially identical to 10 CFR Part 71, Appendix A..

Nebraska needs to revise the following statement from where f(i) is the fraction of activity for radionuclide I in the mixture and A2(i) is the appropriate A1 value for radionuclide I.

Records Nebraska regulations state that records of transfer should be maintained until the Department authorizes their disposition. This appears to be less restrictive as it does not specifically require the

Nebraska needs to state that the records of transfer shall be maintained until license termination to meet the Compatibility Category C designation assigned to 10 CFR 40.61(a)(2).
