Dear Mr. Miltenberger:

SUBJECT: Inspection 50-272/93-13; 50-311/93-13; 50-354/93-09

'

An announced inspection of your emergency preparedness (EP) program was conducted by Mr.

C. Gordon of this office on April 19-23, 1993 at the Artificial Island Site, Lower Alloways

Creek Township, New Jersey. Discussions of our findings were held by Mr. Gordon with Mr.

Hagan and others members of your staff at the end of the inspection.

Areas examined during this inspection are described in the enclosed inspection report. li1 those

areas, the inspection consisted of inspector *observations, interviews with personnel, and

examination of selected procedures and records.

Overa,11, this inspection found generally go0d EP program implementation and Emergency

Response. Organization training. But, shift operating crew performance during walk-through,

table-top drills identified apparent weaknesses in the procedures and/or training for identifying

contµnment bypass conditions and developing protective action recommendations. We will

follow-up further on these matters incident to routine EP inspection.

  • . This inspection also identified a programmatic concern that_your emergency declaration and

reporting procedures appear to differ from the NRC and FEMA guidance in the "Class

Description" sections of Appendix 1 to NUREG-0654/FEMA-REP-l.

Specifically, while

ongoing events are required to be reported, we found no requirement for declaration and

reporting of events that have occurred or which end before declaration and reporting is

accomplished.

That might prevent tiinely NRC, off-site authority, and senior licensee

management review for safety significance and the need for follow-up.

Also, inability to

identify a defined emergency condition might not be communicated to cognizant managers ..

Further, generic implications might not be properly evident through non-inclusion in industry

and NRC records of emergencies. Please review these considerations and advise us in writing,

within 45 days of receiving this letter, of the safety justification for your practice or, if such is

the case, of your plans to change your Emergency Plan and Implementing Procedures to assure

classification and reporting of emergency conditions that have occurred but no longer exist.
