VOGTLE ELECTRIC GENERATING PLANT UNITS 3 AND 4 ISSUANCE OF AMENDMENTS AND GRANTING OF EXEMPTIONS RE: CHANGES TO CONTAINMENT COOLANT AND SPENT FUEL MAKEUP STRATEGIES (LAR 17-021) (EPID NO. L-2017-LLA-0131)
Dear Mr. Whitley:
In response to your application dated July 14, 2017, the U.S. Nuclear Regulatory Commission has granted the enclosed Exemptions and issued the enclosed Amendment Nos. 126 and 125 to Combined Licenses (COL) Nos. NPF-91and NPF-92 for the Vogtle Electric Generating Plant (VEGP) Units 3 and 4, respectively. The amendments consist of changes to the Updated Final Safety Analysis Report in the form of departures from the Plant-Specific Design Control Document (PS-DCD) Tier 2 information and involves changes to the VEGP Units 3 and 4 plant-specific Tier 1 information (and associated COL Appendix C information) and to the VEGP Units 3 and 4 COL Appendix A, Technical Specifications.
Pursuant to the provisions of Title 10 of the Code of Federal Regulations (10 CFR) 52.63(b)(1), an exemption from the elements of the design as certified in the 10 CFR Part 52, Appendix D, Design Certification Rule, is also requested for the PS-DCD Tier 1 material departures. This exemption is related to, and necessary for the granting of the license amendment, which is being issued concurrently with this exemption.
A copy of the related Safety Evaluation, which includes the evaluation of the amendment and exemption, is also enclosed. The notice of issuance of the amendment and exemption documents included in this letter will be published in the Federal Register.
