April 10, 2018 EN 18-006 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: FirstEnergy Nuclear Operating Company EA-18-008 Davis-Besse Nuclear Power Station Docket No.: 50-346

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION A Notice of Violation (NOV) will be issued on or about April 13, 2018, to FirstEnergy Nuclear Operating Company (FENOC), for a violation associated with a White Significance Determination Process finding identified during an inspection at Davis-Besse Nuclear Power Station. The White finding, an issue of low to moderate safety significance, involved FENOCs failure to prescribe appropriate work instructions for an activity affecting quality of the safety-related auxiliary feedwater system. Specifically, FENOC did not provide detailed instructions to maintain an adequate amount of oil in the auxiliary feed pump turbine #1 inboard bearing oil reservoir, which resulted in low oil level and failure of the turbine bearing on September 13, 2017. This finding is a violation of Title 10 of the Code of Federal Regulations Part 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings and also caused a violation of Technical Specification 3.7.5, Emergency Feedwater (EFW) which will also be documented in the NOV.

In accordance with the NRC Enforcement Policy, this NOV is considered an escalated enforcement action because it is associated with a White finding. Additionally, the licensees performance at the Davis-Besse Nuclear Power Station placed the facility in the Regulatory Response column of the NRCs Reactor Oversight Process Action Matrix, effective the fourth quarter of 2017.

On March 9, 2018, the NRC issued a preliminary determination letter for this issue and offered FENOC the opportunity to attend a Regulatory Conference or respond in writing. In a phone call on March 14, 2018, FENOC responded that they did not intend to respond to the preliminary determination letter.

The licensee has not yet been specifically informed of the enforcement action. The schedule of issuance and notification is:
