The Nuclear Regulatory Commission (NRC) has received from the Public Service Electric and Gas Company (PSE&G) a request to modify the Incidental Take Statement con'fi.ained in the Biological Opinion that was sent to the NRC on January 2, 1991.
The proposed changes are detailed in the enclosure.
The NRC staff has reviewed the proposed changes and concurs with the request.
In addition, PSE&G staff has discussed the proposed changes with the National Marine Fisheries Service (NMFS) staff members in Gloucester.
Because NMFS issued the Biological Opinion, we request NMFS's review and approval of the proposed changes.
The NRC staff has requested PSE&G to incorporate the remaining Incidental Take Statement requirements into the Environmental Protection Plans for Salem and Hope Creek.
I appreciate your understanding in this matter and will keep you informed of our actions. If you or your staff desire further discussion of this matter, please contact Mr. James Stone (301 49-21422), our Project Manager for the Salem Nuclear Generating Station.

UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555 April 30, 1991 Mr. W i 11 i am W. Fox, Jr.
Assistant Administrator for Fisheries United States Department of Commerce National Oceanic and Atmospheric Administration National Marine Fisheries Service 1335 East-West Highway Silver Spring, Maryland '20910

ENCLOSURE REQUESTED CHANGES TO INCIDENTAL TAKE STATEMENT Item numbers below refer to the numbered paragraphs of the Incidental Take Statement, Attachment 1 of the Biological Opinion.
Item 2)
Change the reference to the "Hope Creek intake screens" to the "Hope Creek trash bars.
11 The trash bars are the first piece of equipment that the water flows through as it enters the plant. These bars have an open space between them of 2.25 inches.
The sea turtle specimens that have been collected at Salem have been collected on trash bars. Although no specimens have been collected at Hope Creek, it is at this location where they might be found.
Item 3)
Change the frequency of trash bar cleaning at Salem to once per day.
The process of cleaning the trash bars is a slow, cumbersome process that involves heavy equipment and approximately four people (including a security guard). A large mechanical rack must be located over the trash bars and located at the bottom of the bars.
This has to be done a number of times at each of the twelve trash bars. Depending on the debris load, this can take an eight hour shift or longer.
This activity occurs at the beginning of the day shift when adequate station forces are available.
If this procedure were to be done twice in one day it would require the assignment of additional station personnel to the second shift. The data available to date does not suggest higher numbers of specimens being collected during the evening hours.
Item 3)
Delete the requirement to clean the trash bars at Hope Creek once per day.
No specimen has ever been collected or observed at Hope Creek.
The intake at Hope Creek is not similar to the Salem Circulating Water Intake Structure where the specimens have all been collected. The Hope Creek intake is very similar to the Salem Service Water Intake Structure and no specimens have ever been collected or observed there either.
Item 6)
Delete from the reporting form (Appendix II) the requirement to report the intake velocity. This parameter is not routinely collected and due to the complex hydrodynamics of the intake a single point measurement would not be representative of the events involved at the time of the impingement.
If the animal was impinged underwater and worked its way to the surface, there would be no way to know where the specimen was originally trapped and therefore, the velocity could not be measured at the appropriate location.
Please modify the*heading 11 Results of necropsy (include stomach contents) 11 by adding 11 if available at the time of the report or as soon as possible.
11 Any necropsy performed is done by the Marine Mammal Stranding Center and the Company cannot ensure that this work will be done within the thirty day reporting requirement.
