APPENDIX A NOTICE OF VIOLATION Public Service Electric and Gas Company Salem Nuclear Generating Station Docket Nos.
50-272 50-311 License Nos. DPR-70 DPR-75 As a result of the inspection conducted on November 17-29, 1989, and in accordance with 11General Statement of Policy and Procedure for NRC Enforcement Actions 11, 10 CFR 2, Appendix C (Enforcement Policy 1989), the following violation was identified:
10 CFR 50.59 permits a licensee to make changes to procedures as described in the safety analysis report without prior NRC approval, unless the pro-posed change involves an unreviewed safety question.
Updated Final Safety Analysis Report (UFSAR) Section 13.5.3 describes the implementation of Emergency Operating Instructions (procedures) to assure that proper actions are taken to combat malfunctions.
UFSAR Section 6.1.1.4 requires the emergency core cooling systems (ECCS) to perform its safety function assuming the most limiting single failure.
Contrary to the above, on Novemher 17, 1989, emergency operating procedure changes were implemented without prior NRC approval; and those changes involved an unreviewed safety question, in that, the changes reestablished a single failure vulnerability in an ECCS, thereby increasing the probability of failure of the ECCS during an accident.
This has been evaluated as a severity level IV violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Public Service Electric and Gas Company is hereby required to submit to this office within 30 days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending this response time.
