(May 9, 1980)
At the close of he~ring held on April 28, 29, and 30, in the above-captioned proceeding, two oral motions were made to,the board.
First, Lower Alloways Creek Township moved to have the board order both the staff of the Nuclear Regulatory Commission and the licensee, Public Service Electric and Gas Company, to._.conduct further analysis of the possibility that oxidation could propagate from spent fuel recently discharged from the reactor to spent fuel aged four years or more in the event of a gross loss of water in the spent fuel storage pool.
Second, the ~
licensee moved the board to close the evidentiary recor<:!,~ ~
The board has decided after considering carefully the argument made by the Township in support of its motion, that the further analysis *cannot be justified in light of
2 -
the evidence which has already been received.
Accordingly, the licensee's motion to close the record is hereby granted, and the Township's motion to have the board order further analysis is hereby denied.
The parties are hereby directed to file proposed findings of fact and conclusions of law, together with a proposed form of order or decision, in accordance with 10 CFR §2.754, except that all parties are hereby accorded 45 days from the date of service of this order to file such proposed findings and conclusions.
