On September 4, 1979, the final fuel cycle rule, 11Uranium Fuel Cycle Impacts From Spent Fuel Reprocessing and Radfoactive Waste Management, 11 will become

  • effective. The Supplemental Information (the full text will appear in the Federal Register) accompanying the rule states in part:

In*response to a recent decision by the United States Court of Appeals for the District of Columbia Circuit, State of. Minnesota v. NRC, *Nos. 78-1269 and 78-2032 (May 23, 1979), the Commission intends to conduct a generic proceeding which wil 1 consider the most recent evidence regarding the likelihood that nuclear. waste can be safely disposed of and when that, or some other off-site. storage solution, can be accomplished.

That new generic waste disposal proceeding will be separate and different in.*

scope and* purpose from further fuel cycle rulernakings*

dealihg with an S-3 narrative and general update of S-3, but will in part review and update the conclusions re-garding waste disposal which have been reached in the present rulemaking.

If available, the record compiled in the new generic' waste dispo_sal proceeding can be

,considered in, and made a part of the record in, the general update of S-3.

This statement by the Commission is consistent with the Staff's and Licensee's

_position regarding the Motion for Reconsideration of Dismissal of Col enians 1

  • Contention Number Seven.
