Dear Mayor Donelson:

The Commission is in receipt of the Februa17y 16,, 1979 reso1utfon by the Tmmship of LoNer A1loway 1 s Creek (the Tmmship) opposing the storage of high level radioactive wastes in the Township.

The four items identified-in that resolution have been referred to me for reply.

With regard to the first item, in which the Township states its opposition to the concept of reracking spent fuel at Salem Units l and 2 and Hope Creek Units 1 and 2, the Township is a party in the.hearing pending before the f\\tomic Safety and Licensing Roard

_ (ASLB) for the proposed ex~an~ion of the spent fuel pool storage capacity at Sa 1 em Uni:t No. l. The Township; as a-party to that hearing, \\'-ii 11 have the opportunity to state its object ion to the -

proposed expansion of the spent fuel pool capacity.

The other facilities under construction on Artificial Island, SaleD Unit.

2 and Hope Creek Units l a.nd 2 have not yet received their operating licenses.

In item number two, the Township states its opposition to the construction of at-reactor site cooling pools or spent fuel pools to enlarge the caracity cf storage of spent fuel on Artificial Island. W~ interpret item number two to mean that the Township is opposed to construction of spent fuel pools in addition to those already included in the original design of the facilities on Artificial rslamL In i-!UREG-0404, the NRC staff's draft gener1c environmental

  • impict ~taternent on handling and storage 6f sp~ni light water power reactor fuel, w~ state that increasing the capacity of existing, inrlividual spent fuel stora9f~ pools is environmentally ac~eptable,

- but that each application for such an expansion would be reviewed on a case-by-case basis. If such an expansion does occur, as proposed*

at Salem Unit 1, the resultant capacity would most likely be sufficient to meet the storage requirements until sometime after the away-from-reactor storage is av~ilRble. The need for constructing an additional BURNAlllll~

its opposit.ion to locating any independent storage facilities for spent fuel within the Township, the Commission is unaware of any pl ans \\'Jhich would propose such* a facility. Furthermore, should such an action be proposed, an ~ppropriate public notice would b~ issued in the Federal Register.

  • Subsection (C) of Section 5877, which is based on the Energy Reorganization Act of 1974 which created the Nuclear Regu.l atory Commission, requires the Commission to make an annual report to the President for submission to Congress on the activities of the -

Commission during the preceping fiscal year, including 11 *** a destription of the Commission's activities ~nd findings *** " in six areas, one of t-1hich is

  • 11 (5) insuring the.safe, permanent disposal of high-level ~adioactive wastes through the licensing of nuclear activities and facilities". The Cpmmission has con~istently fulfilled its obligation to provid.e this inform.ation. The.latest report was forwarded to the President on February' 14*, 1979.

A copy of that report is enclosed for your infonnation. Statutory reporting '

requirements are highlighted _on page xi and in Chapters* l *and 5 of that report.
