NOTICE OF VIOLATION Consumers Power Company Palisades Nuclear Generating Plant Docket No. 50-255 License No. DPR-20 During an NRC inspection conducted on September 7 through October 18, 1996, a violation of NRC requirements was identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR 50, Appendix 8, Criterion V, "Instructions, Procedures, and Drawings," requires that activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions,.procedur~s, or drawings.
Licensee procedure 3.03, "Corrective Action Process," Revision 15, Paragraph 7.1, required that upon discovery of any condition requiring a condition report (CR), an individual shall initiate a CR and i11111ediately hand carry the CR to the individual's supervisor.
Licensee procedure 3.03, Attachment 10, "Condition Report Guidelines,"
Revtsion 15, required, in part, "That a condition report should be written whenever: Information from external sources (eg, vendors, INPO, NRC) that (sic) indicates a potential problem at Palisades."
Contrary to the above:
Licensee staff failed to initiate a CR upon discovery that Palisades was potentially susceptible to the problem described in NRC Information Notice 96-45 "Potential Common-Mode Post Accident Failure of Containment Coolers."
This is a Severity Level IV violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, Consumers Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the
- -*-corrective-step*s-that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response.

Notice of Violation issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
Under the authority of Section 182 of the Act, 42 U.S.C. 2232, this response shall be submitted under oath or affirmation.
Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards infonnation so that it can be placed in the PDR without redaction. However, if you find it necessary to include such infonnation, you should clearly indicate the specific information that you desire not to be placed in the POR, and provide the legal basis to support your request for withholding the infonnation from the public.
