SUBJECT:

NRC INSPECTION REPORT NO. 50-255/94017(DRP)

This refers to the inspection conducted by Messrs. M. E. Parker and

D. G. Passehl of this office from August 30 through October 12, 1994.

The inspection included a review of activities authorized frir your Palisades

Nuclear Generating Facility.

At the conclusion of the inspection, the

findings were discussed ~ith those members~f your staff -identified in the~

enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and tepresentative records and interviews with personnel~ The purpose of-the

inspection was to determine whether activities authorized by the license were.

conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, three apparent violations were

identified and are being considered for escalated enforcement action in

accordance with the "General Statement of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Policy}, 10 CFR Pirt 2, Appendix C.

Accordingly, no Notice of Violation is pr~sentlj being issued for these

inspection findings.

The apparent violations pertain to the discovery that

each-of the two emergency diesel generators (EDGs) was unable to supply design

basis accident loads.

EOG 1-1 had a negative margin of about 9 percent~ and

EOG 1-2 had a negative margin of less than 1 percent.

The violations involve

(1) failure to perform adequate post-maintenance testing in accordance with 10

CFR 50 Appendi~ B Criterion XI; (2) failure to perform vendor-reco.mmended

maintenance in accordance with Technical Specification 4.7.1.c; and (3)

failure to perform adequate safety evaluations.

In addition, the number and

characterization of apparent violations described in the enclosed inspection

report may change as a result of further NRC review.

An Enforcement Conference to discuss these apparent violations has been -

scheduled fof 1 p.m. (CST) on November 1, 1994, at the Region III office.

The decisio~ to hold an Enforcement Conference does not mean that the NRC has

determined that a violati~n has occu~red or that enforcement action will be

  • taken.

The purposes of this conference are to discuss the apparent

violations, their causes and safety significance; to provide you the

opportunity to point out any errors in our inspection report; and to provide

an opportunity for you to present your proposed corrective actions.

In

particular, ~e expect you to address your evaluation of the past operability

of the EDGs, given the reduced load capabilities, and any long term actions

you intend to take to ensure continued ability of the EDGs t.o carry ~ccident

loads.

We also expect you to discuss the programmatic aspects of this issue

with respect to other safety rela.ted systems (e.g. battery loading).

In

addition, this is an opportunity for you to provide any information concerning

your perspectives on 1) the severity of the violations,* 2) the application of

the factors that the NRC considers when it determines the amount of a civil

penalty that m~y be assessed in accordance with Section VI.B.2 of the*

.

Enforcement Policy, and 3) any -0th~r application of the Enforcement Policy to

this case, including the exercise of discretioh in ~ccordance with Section

VII.

You will be .advised by separate correspondence of the results of our

.. deliberations on this matter .. No response regarding these apparent violations-

is required at this time.

In ~ccordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of*

this letter and its enclosure wil] be placed in the NRC Public Document Room.
