PROPOSED IMPOSITION OF CIVIL PENALTY -

$50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about May 6, 1994 to Consumers Power Company.

This action is based on the inspection which identified five instances of inadequate engineering evaluations: one

  • involved a single failure vulnerability which could have led to the loss of all engineered safeguards system pumps and the other four involved the licensee's service water Safety System Design Confirmation (SSDC) program in June 1989, and the component cooling water SSDC in June 1990.

All examples exhibited -

.inadequate engineering evaluations and lack of management involvement in the SSDC process.

The violation in this regard has been categorized at Severity Level III.

Enforcement Discretion was exercised by taking into consideration the licensee's effort to address and correct the performance problems and the significant senior management changes that have taken place at Palisades in an effort to improve performance.

This exercise of discretion limited the civil penalty tci the base amount of $50,000~

It should be noted that the licensee has not been specifically informed of the enforcement action.

Mailing of Notice May 6, 1994 Telephorie Notification of Licensee May 6, 1994 The State of Michigan will be riotified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or.imposed by Order.
