Consumers Power Company (Palisades)

Subject:
PROPOSED IMPOSITION OF' CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about September 14, 1993, to Consumers Power Company (Palisades Nuclear Plant).
This action is based on a June 15, 1993 event in which the licensee failed to uncouple one control rod* prior to removal of the reactor vessel head.
The violation is.reflected in (1) the failure of a Shift Supervisor *.
to pre~rief the auxiliary operators involved in the control rod uncoupling evolution; (2) failure of the auxiliary operators to conduct a dry run on a mock-up prior to the evolution as required by procedures; (3) the failure*to notify the control room after each control rod drive mechanism was uncoupled, as required by procedures; (4) a failure to retain the working copy of the rod uncoupling procedure; and (5) an inadequate procedure for verifying that the rods were uncoupled during removal of-the reactor vessel head.
Collectively, these failures ~e~res~nt a
- breakdown in the controls that are essential for the safe conduct of the vessel head removal activities.
In this case, the base severity Level III civil penalty of
$5o,ooo*could have* been mitigated by 50 percent (to $25,000) in recognition of the licensee's comprehensive corrective actions following this event.
However, to reflect the level of concern with which the staff viewed the licensee.'s failure to instiil in individuals a proper regard for compliance with procedures and to emphasize the need for careful attention to the control and conduct of the licensed activities involved here, the staff decided to. exercise discretion, pursua.nt *to Section VII.A. i of - - -.
the Enforcement Policy, and to propose a civil penalty in the amount of the base civii penalty,* notwithstanding the application Of the mitigation factors.
Accordingly, a civil penalty in the amount of $50,000 is being proposed.
It should be noted that the licensee has not been specif icaliy informed of the enforcement action.
