Dear Ms. Schmitt:

We have reviewed the final revisions to the Nebraska regulations to Title 180 NAC 1, 3, 4, 5, 13, 14, 19, and 24, received by our office on January 18, 2018. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2011-1, 2011-2, 2012-2, 2012-3, 2012-4, 2013-1, and 2013-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on March 13, 2018.

As a result of our review, we have six comments related to compatibility and/or health and safety, and four comments not related to compatibility, identified in the enclosure. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Nebraska, in response to our comments, and provide a copy to Division of Materials Safety, Security, State and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Nebraska regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Gas and aerosol detectors containing byproduct material Nebraska needs to remove the redundancy identified in Chapter 3-004.03, Item 3.a. The phrase that such person receives, possesses, uses, transfers, owns or acquires radioactive material, in gas and aerosol detectors designed to is duplicated in Chapter 3-004.03, Item 3.a.

Nebraska needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 30.20.

Nebraska needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 37.27(c).

§40.22(b)(1)-(3) 2013-2 B

Small quantities of source material Nebraska needs to include an equivalent provision to 10 CFR 40.10, "Deliberate misconduct."

Nebraska needs to correct the cross reference to Chapter 3-017.10 included in Chapter 3-007.02. This section of the regulation could not be found.

Nebraska needs to make the above changes to meet the Compatibility Category B designation assigned to 10 CFR 40.22(b)(1)-(3).
