NOTICE OF ViOLATION Consumers Power Company Palisades Nuclear Generating Plant Docket No. 50-255 License No. DPR-20 EA 90-179 During NRC inspections conducted on August 13 through October 29, 1990, a violation of NRC requirements was id~ntified.

  • In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violation is listed below:

Technical Specification 6.12.1 requires that individuals* permitted to enter a high radiation area must be accompanied by a radiation monitoring device which continuously indicates dose rates or by an individual qual)fied in radiation protection procedures who is equipped with a radiation dose rate device.

Contrary to the above, on December 7, 1989, a Plant Support Supervisor and an Auxn iary Operator entered a posted high radiation area without a radiation monitoring device which continuously indicated dcise rates and were not accompanied by an individual who was qualified in radiation protection procedures who possessed a radiation dose rate device.

This ~s a Severity Level IV violation (Supplement IV).

Pursuant tti the provisions bf 10 CFR 2.201, Consumers Power Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C. 20555, with a copy.to the Regional Administrator, Region III, U.S. Nuclear Regulatory Commission, 799 Roosevelt Road, Glen Ellyn, Illinois

  • 60137, and a copy to the NRC Resident Inspector at the Palisades Nuclear Plant within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply
  • should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to

~void further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Consideration may be given to extending the response time for good cause shown.
