Consumers Power Company Palisades Nuclear Power Plant NOTICE OF VIOLATION Docket No. 50-255 License No. DPR-20 As a result of the inspection conducted on November 5-9, 1990 and in accordance with th 11 General Statement of Policy and Procedure for NRC Enforcement Actions, 11 10 CFR Part 2, Appendix C, (1990) (Enforcement Policy) the following violations were identified:

10 CFR 50.47(b)(l) states in part, 11each principal response organization has staff to respond and to augment its initial response on a continuous basis.

11 10 CFR 50.47(b)(15) states, 11 Radiological emergency response training is provided to those who may be called on to assist in an emergency.

11 Palisades Technical Specifications, Chapter 6.8.1, requires implementation of the Site Emergency Implementation Procedures.

Procedure EI-2.2, Attachments 1-3, requires the following augmentation of the emergency response organization:

one TSC communicator within 30 minutes; two additional TSC communicators within 60 minutes; and an EOF Reactor Engineering Operations Team Member within 60 minutes.

Contrary to the above, during November 1990, there were only four trained/qualified TSC Communicators.

Therefore, there would have been insufficient personnel for continuous staffing of two TSC Communicator positions. Also, during October 1990, there were no qualified EOF Reactbr Engineering Operation Team Members.

Therefore, there would have been insufficient personnel for the in1tial or continuous staffing of the EOF Reactor Engineering Operation Team.

This is a Severity Level IV violation (Supplement VIII).

2.

50.54(q) requires that a licensee authorized to possess and operate a nuclear power reactor shall follow and maintain in effect emergency plans which meet the standards in 50.47(b) and the requirements of Appendix E to Part 50.

The Site Emergency Plan, Section 5, Figure 5-6 states that the licensee will have a Senior HP expert respond to an emergency in 30 minutes with the major task of performing dose assessment.

10 CFR 50.47(b)(15) states, 11 Radiological emergency response training is provided to those who may be called on to assist in an emergency.

11 Contrary to the above, the licensee maintained a person untrained in dose assessment on the augmentation list to respond within 30 minutes from February to November 1990.

This is a Severity Level IV violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice of Violation a written

statement or explanation in reply, including for each violation:

(1) the corrective steps that hive been taken and the results achieved; (2) the steps that will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consjderation may be given to extending your response time for good cause shown.
