The NRC staff notes the clarifications provided in your*
- 1~tter to the facts as stated in the NRC' s November 23, 1988 Notice of Violation and Proposed Imposition of Civii Penalty.
However, after review of your clarifications the NRC staff maintains the violations occurred as stated in the November 23, 1988 letter.
In regard to the violation associated with butyl rubber insulated cables (Violatior1 II.e), you are correct ir. stating thh matter was not addressed ir NRC Inspettion Report No. 86032 which covered the inspection period December 8, 1986 through January 13, 1987.
During that inspection, your staff sci.id Palisades had no butyl rubber.insulcted cable ir1 use in harsh environments.
During a subsequent NRC fo llowup inspection on December 7-9, 1987, it was dttermined that butyl rubber insulated cable was in use in the HPCJ room, a harsh environment.
New testing and analysis was required to estabiish qualificatiGn of this cable.
