Consumers Power Company Palisades Docket No. 50-255 (EA 88-140)
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notfre of Violation and Proposed Im~osition of Civil Penalty in the amount of Seventy-Five Thousand Dollars
($75,000) wi*ll be issued on or about December 22, 1988 to Consumers Power Company.
This action is based on the failure to satisfy fire protection requirements of 10 CFR Part 50, Appendix R and the failure of management to take aggressive and timely corrective action.
The escalation and mitigation factors in the Enforcement Policy were considered and the base civil penalty amount was increased by 50 percent because-of the duration of the violation (from 1986 to 1988).
It should be noted that the licensee has not been specifically informed of.the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Michigan will be notified.
December 22, 1988 December 22, 1988 The licensee*has* thirty days from t~e date of the Notice in which to respond.
Following NRC evaiuation of.the response, the civil penalty may be r~mitted, mitigated, or imposed.bY Order.
