Consumers Power expects to lose capability to store an amount of spent fuel equal to the core of the Palisades reactor in that reactor's spent fuel storage pool in 1992. Therefore, CP is examining other spent fuel storage capacity alternatives. These include in-pool rod consolidation and fuel rod storage (an option which would not provide sufficient capacity to store spent fuel through life of plant) and various dry storage technology designs for licensed storage under 10 CFR Part 72.
CP has requested the Department of Energy verbally, and 'will follow that with a request in writing, to appraise the legislature of the State of Michigan of the safety of storage options other than storage in aboveground reactor pools.
NRC has received a letter from a member of the Michigan State House of Representatives, the Honorable James Mick Middaugh, on this subject (see ).

Disadvantages:

Time consuming, labor and equipment intensive work.
- b.
Will not likely satisfy storage needs until DOE accepts _fuel.
- c.
Higher levels of radiological exposure and contamination.

Single storage method until DOE accepts fuel

Duke Power has coamitted to Nutech's NUHOMS design for their Oconee Plant.

Baltimore Gas & Electric will be awarding a bid in approximately 30 days to either a rod consolidation or dry storage vendor.

The NRC topical review of the Westinghouse MC-10 dry storage cask has been approved.

The NRC topical review of Nuclear Assurance Corporation's S/T cask has been approved.

The NRC topical review of Foster Wheeler's Modular Vault Dry Store facility has been approved.

NRC topical reviews of Combustion Engineering's Dry Cap cask, Transnuclear's TN-24P cask, and Pacific Sierra's CP-9 cask are all in progress.

Attempt to identify other means to solve fuel storage problem before the consolidation option is exhausted.

Operate without full core offload capability as long as possible.
- d.
Shutdown plant when no fuel storage space remains for additional cycles.
If P.A. 113 is changed to allow aboveground dry fuel storage, CPCo will:
- a.
Evaluate rod consolidation and dry storage bids ori their technical and economic merit.
- b.
Select the most desirable fuel storage option.

MINORITY VICE CHAIRMAN EDUCATION LIQUOR CONTROL Present Michigan law limits the storage of speni fuel to aboveground spent fuel pools.
Because of anticipated space limitations, Michigan utilities are evaluating.storage of dry spent fuel in aboveground casks or vaults at commercial nuclear generating plants in this state. For this to be permissible, State law must be amended to allow d~y aboveground storage of spent nuclear fuel.
Before proceeding with arrangements to consider amending the existing law to allow dry aboveground storage of spent fuel in casks, vaults or pools, I would like assurance from the Nuclear Regulatory Commission that allowing this aboveground storage would not decrease the safety of the public Please forward the NRC's position on this 1 matter--~fo me as soon as possible.

/2-11'*17 ENROLLED SENATE BILL No. 66 AN ACT to amend the title and section 1 of Act No. 113 of the Public Acts of 1978, entitled "An act to regulate the depositing, storing, or both, of radioacttve waste; and to require certain reports on the effect of this act," being section 325.491 of the Michigan Compiled Laws: and to repeal certain acts and parts of acts.
The People of the State of Michigan enact:
Section 1. The title and section 1 of Act No. 113 of the Public Acts of 1978, being section 325.491 of the Michigan Compiled Laws, are amended to read as follows:
TITLE An act to regulate the depositing, storing, or both, of radioactive waste.
Sec. 1. (1) Radioactive waste may not be deposited or stored in this state.
(2) Subsection (1) shall not apply to:
(a) The safe and secure storing or disposal in aboveground\\f~~-iliti-;Jflt the site of an educational institution that produces radioactive waste of spent fuel rods produced by that educational institution.
(b) The safe and secure storage in aboveground etOragepOQl§i located at or near a nuclear power generating' facility of spent fuel rods, or the safe and secure storage at the site of a nuclear power generating facility of low-level radioactive waste produced at that nuclear power generating facility.
(c) Waste consisting of uranium tailings that result from uranium mining within this state.
(d) The safe and secure temporary storage at the site of a nuclear power generating facility for not.more than 2 days of any radioactive materials incidental to transportation of those materials.
(e) The normal usage and safe and secure storage of radioactive materials used by doctor's offices, hospitals, health clinics, or other medical research or medical treatment centers.
(f) The safe and secure storage or disposal, or both. of low-level radioactive waste pursuant to Act No. 460 of the Public Acts of 1982, being sections 3.751 to 3.752 of the Michigan Compiled Laws, and to part 137 of the public health code, Act No. 368 of the Public Acts of 1978, being sections 333.13701 to 333.13741 of the Michigan Com.piled Laws.

(g) The safe and secure storage or disposal of radioactive waste with radioactivity less than the amount that would require a specific license under part 135 of the public health code, Act No. 368 of the Public Acts of 1978, being sections 333.13501 to 333.13536 of the Michigan Compiled Laws and rules promulgated under that part.
(h) The safe and secure storage of radioactive waste that was being stored before January 1, 1970 and that is stored in a manner approved by the department of public health so as not to create a hazard to the public health, safety, or welfare.
Section 2. Section 2 of Act No. 113 of the Public Acts of 1978, being section 325.492 of the Michigan Compiled Laws, is repealed.
Section 3. This act shall not take effect unless Senate Bill No. 65 of the 84th Legislature is enacted into law.
