On ~arch 3, 1986, the U. S. Depariment of Labor's (DOL) Wage and Hour Division in Grand Rapids, Michigan, received a complaint from a former electrician who had been employed by Consumers Power Company at the Palisades Nuclear Plant.
The former electrician alleged that an adverse job action had been taken against him after he had raised safety concerns while performing his duties and that Consumers Power Company failed to properly investigate the matter.
In response to that complaint, the Wage and Hour Division arranged a mutually agreeable settlement between the electrician and Consumers Power Company.
_Notwithstanding this settlement, the NRC is concerned that a violation of the employee protection provisions set forth in 10 CFR 50.7 may have oc,curred involving the manner in which Consumers Power. Company addressed the matter.
Further, the NRC is concerned that the company's apparent failure to safeguard the identity of the electrician subsequent to his report, the apparent failure to effectively control the harassment to which he was subjected by his fellow workers, and the personnel actions taken by the company in this regard may discourage other individuals from reporting similar concerns.
Therefore, to resolve this matter, you are requested to provide the following information to this office within 30 days of receipt of this letter:
.1-A determination of.the cause of the failure to safeguard the electrician's i~ehtity and what actions you have taken or will take to ensure that other employees ~ho find themselves in similar circumstances are properly protected.
- 2.
A evaluation of the methods used to control harassment from fellow workers, what actions you have taken or will take to correct their apparent inadequacy, what disciplinary action was taken with regard to any individuals engaging in known acts of harassment, and the basis for that disciplinary action.
- 3.
An evaluation of the basis for all personnel actions (e.g. suspensions, psychological re-examinations, etc.) taken with regard to this matter.

What actions you have taken or will take to ensure that this matter has not discouraged, nor will in the future discourage, other plant employees from reporting similar concerns.
We will be glad to discuss any questions you may have regarding this matter.
After reviewing your response the NRC will determine whether ~dditional actions is* needed and whether enforcement action is necessary to ensure compliance with regulatory requirements.
