By application dated May 11, 1981, your Company requested Technica 1 Specification changes to define the upper boundary for eorf chment of assemblies to be stored 1n the Palisades spent fuel pool. A Class 111 fee ($4,000) was remitted tlith your application pursuant to 10 CFR 170.22 of the March 23, 1978 r.egulations.

Based on. information provided.by the Office of Nuclear Reactor Regulation

{ONRR) staff, it bas been determined that this applfeatfon should be exempted

• from the fee requirements of 10 CFR 170 of the March 23 regulations since no action has been taken on the application nor will any ac:tlon be taken on it.

On this basis, we have concluded that an exemption, pursuant to 10 CFR 170. ll(b), from the fee requirements is authorized by law and such exemption is othenrise in the public interest and is hereby granted for the May 11, 1981 application. Therefore, a refund of $4,000 is apprqpriate. Accordingly, we bave concurrently authorized the Div,ision of Accounting and Finance to refund

$4,000 to your Company.

Refunds are generally pr(>t;~sse.d.with a two!'"week period.
