SETTLEMENT OF PROCEEDING ON ORDER IMPOSING CIVIL MONETARY PENAL TIES By EN-79-16, dated December 20, 1979, the Commission was informed that an Order Imposing Civil Penalties in the amount of Four Hundred Fifty Thousand Dollars had been issued to Consumers Power Company.
This action was based on three alleged items of noncompliance which involved violation of containment
.integrity over a period of about 17 months.
In a letter dated January 8, 1980, the licensee requested a hearing in accordance with paragraph V of the December 20, 1979 Order and the provisions of 10 CFR 2.205.
IE and Consumers Power Company reached an agreement in the matter whereby Consumers Power Company has agreed to pay civil penalties in the amount of Two Hundred Twenty-Five Thousand Dollars.
Ths &ettlement notes dtspute over the length of time containment integrity was not maintained but notes that containment integrity was violated in excess of one day when the plant was in other than cold shutdown.
The Staff and the Licensee have filed a stipulation with the Administrative Law Judge assigned to the case providing the terms of the settlement.
This action involves mitigation of imposed civil penalties and a press release wi 11 be made.
