This action* is based on*
alleged violatiops associated with isolation of the station batteries during.
- plant operatfon on January 6, 1981.
The violations.include:
- 1) Failure to
- .implement. appf".opriate procedures and 2) Inadequate administrative procedures.
- The violations initia.ted an.Immediate Action Letter' issued January 9, 1981. and an ensuing March 9, 1981 Order Confirming Licensee Actions to Upgrade Facility.
Performance.
Imposition of a civil penalty was also* considered for this matter.
The* Interim Enforcement Policy, (45 FR 66754, October 7, 1980) allows: Orders.
and/or civil penalties to be issued for violations..
- The staff is establishing a practice not to issue Confirmatory Orders and civil penalties for the same
- vi.ola.Uon unless* the actions can be taken within a reasonably short period of.
time;* the period we intend t~ µse as a guide is one encompassing ten worki~g
- days.
In this case,. the regional recommendation for civil penalties was submitted 19 working days after issuance of the Confirmatory Order, but more time passed be.fore the matter came to the* speci fiC. attention of the. OffiCe Di rect9r.
For tliis reason and because a civ11 penalty would be.solely punitive because it
. would not result. in corrective actions beyond those already taken or planned in response to the Order, the decision was made to not assess a* civil penalty for thi.s event.
The deterrent effect of a civil penalty Con otlier licensees)
- was considered but we con.cluded*that civil penalty-action would not have such
. an additional substantive impact for this case at this time~
A regiona_l Notice of Violation will be issued identifying: 1) *the battery
. isolation event as a Severity Level *nr violation, 2) failure to implement procedures as a Severity Level V violation, and 3) inadequate procedures as a Severity Level VI violation.
It.~hould be rioted that the licensee has not been specifically informed of the enforcement action.
With respect to violation l) above, inspection verified
- that corrective actions had been.taken.
F'or vio.l at ions 2) and* 3), above, the licensee is required to respond within 30 days concerning nis corrective actions.
