In the Matter of Consumers Power Company

Docket No. 50-255 (Civil Penalty)
The purpose of this letter is to provide you with a report on the status of dis-covery and other prehearing matters in this proceeding pursuant to your Memorandum and Order dated February 29, 1980.
Counsel for the NRC Staff and the Licensee have discussed and agreed to the contents of this letter.
The NRC Staff will file an answer on July 3, 1980, to Consumers Power Company's supplemental motion to compel discovery.
Upon submission of the Staff's answer, the question of appropriateness of the discovery will have been fully briefed and be ripe for decision by the ALJ.
By letter dated June 23, 1980, the Staff provided Consumers Power Company with additional responses to Consumers' request under the Freedom of Information Act.
The Staff has received and is currently evaluating Consumers' responses to the Staff's first round interrogatories. Consumers is currently evaluating the need to direct further discovery requests to the Staff and should reach a decision within the next two weeks.
The Staff is also considering the need for further discovery requests.
