Enclo~ed is a copy of a recent enforcement action against Consumers Power Company.

I am forwarding a copy of this action to chief executives of all utilities with a power reactor operating license or a construction permit.

This is being done to notify licensees that I intend to use the limit of our enforcement authority, when the circumstances warrant, to obtain safer opera-tion of licensed facilities.

The Three Mile Island accident has re-emphasized that procedures and personnel performance are key elements of a sound nuclear safety program.

Good procedures and high quality performance can only be attained through continued emphasis and attention by all levels of management.

  • Lack of effecttve management action led to the noncOmpliances which resuited in the actions taken against Consumers.

If serious brea~hes of safety such as this occur at your facilities, you may expect enforcement actions of this type or even more stringent.

As you know, our enforcement program is meant to b~ a preventive safety force.

It is intended to be an added incentive for licensees to take those actidns necessc.ry to provide high assurance that plc.nts are built and opera~ed safely.

This letter is intended to urge preventive actions.

I expect you to review your own situation and take whatever steps are neces.sary to improve your management systems for assuring that the high level of safety performance required of the nuclear industry is provided at your facilities.
