Dear Ms. Opila:

We have reviewed the final revisions to the Colorado Rules and Regulations Pertaining to Radiation Control, 6 CCR 1007-1, Part 1, General Provisions; 6 CCR 1007-1, Part 17, Transportation of Radioactive Material; and 6 CCR 1007-1, Part 22, Physical Protection of Category 1 and Category 2 Quantities of Radiaoactive Material, received by our office on January 24, 2018. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2015-3 and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with James Jarvis on March 6, 2018.

As a result of our review, we have two comments related to compatibility, and two editorial comments not related to compatibility that have been identified in the enclosure. Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Colorado, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Colorado regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. 17.7 71.17(c)(3) 2015-3 B

General license: NRC-approved package Colorado needs to revise paragraph 17.7.1 to read (deleted text shown by strikethrough; inserted text shown by underline): licensed material in a package for which a license, NRC issued Certificate of Compliance, or other approval has been issued by the NRC Department. As it currently is written, it could be interpreted as stating that a) Colorado issues NRC COCs or b) that licenses or other approvals issued by the Department authorize a general license.

Similarly, paragraph 17.7.3.2 should be revised to read as follows:

Comply with the terms and conditions of the license, NRC issued Certificate of Compliance, or other approval issued by the NRC Department, as applicable, In addition, the previous comment in the NRC letter dated 04/06/2017 (ML17052A080) stating that the general licensee should notify Colorado before first use of an NRC approved package, has been rescinded. Consistent with 10 CFR 71.17(c)(3), the licensees should submit this information to the NRC.

Colorado needs to revise 17.7.3.3. to state [S]ubmit in writing before the first use of the package to: ATTN:

Document Control Desk, Director, Division of Spent Fuel Storage and Transportation, Office of Nuclear Material Safety and Safeguards, using an appropriate method listed in

§ 71.1(a), the licensee's name and license number and the package identification number specified in the

Colorado needs to make the changes indicated above in order to meet the Compatibility Category B designation assigned to 10 CFR 71.17.

2 22.27.1 &

22.27.A.1 37.77(a)(1) 2015-5 B

Advance notification of shipment of category 1 quantities of radioactive material Colorado omitted referencing the NRC in three locations:

(1) Add NRC to 22.27.1 so that it reads: each licensee shall provide advanced notification to the NRC, Department and the governor...;

(2) Add NRC to the first sentence in paragraph 22.27.1.A.1 so that it reads:

The notification to the NRC, the office of each appropriate governor.; and (3) add the following two sentences to the end of 22.27.1.A.1: Notification to the NRC must be to the NRC's Director, Division of Security Policy, Office of Nuclear Security and Incident Response, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001.

The notification to the NRC may be made by email to RAMQC_SHIPMENTS@nrc.g ov or by fax to 301-816-5151.

Colorado needs to make these changes so that an Agreement State licensee knows to notify the NRC of a Category 1 shipment that would enter or cross through a non-Agreement State.
