By letter of April 22, 1997, you'rovided several written questions and comments in response to the NRC's meeting with the public on April 14,
- 1997, regarding the Unit 1 core shroud at Nine Mile Point Nuclear Station.
You.
indicate that your questions are directed to the NRC and elected officials.
I appreciate this opportunity to respond to the questions that fall within the NRC's jurisdiction.
You indicate that NRC stated at the meeting that the financial investment that Niagara Mohawk Power Corporation has in this facility should be considered in determining whether Unit 1 should be restarted.
As I recall, the remarks regarding financial investment (and consideration of the best interest of the customers) were not made by the NRC, but by Hr. B. Ralph Sylvia, Executive Vice President Generation Business Group and Chief Nuclear Officer of Niagara Mohawk.
The NRC's decision regarding Niagara Mohawk's request to operate with the modified tie rod assemblies for about 14-1/2 months before re-inspecting the shroud will be based upon technical matters that relate to safe operation in accordance with the Commission's regulation.
You state that when Unit 1 was built almost 30 years ago, the expectation for its useful life'as 17 years.
Actually, Unit 1 was designed and constructed for a useful life of at least 40 years.
In accordance with the standard practice of the Atomic Energy Commission at the time, the initial operating license issued in 1969 was a provisional license (i.e., Provisional Operating License No. DPR-17 dated August 22, 1969) to provide a period for observation and improvement.
This was converted to a full-term operating license (Facility Operating License No. DPR-63) in late 1974 with an effective expiration date of August 22, 2009.
The issuance of a provisional license did not mean that the expected useful life was less than 40 years.
lg Your questions also reflect a concern for the potential, impact a major accident could have upon use of the lake as a water supply and to the economy of New York and neighboring areas.
The NRC is conducting a careful review of
. Niagara mohawk's analyses and plans to assure that such operation will not have a significant adverse affect upon the probability or consequences of an
- accident, and we will not authorize resumption as proposed unless we find upon+
completion of onr review that the proposed modifications are acceptable and P'/7 meet the codes and standards required by the Commission's regulations.,
