AND NOTICE OF VIOLATION

Dear Mr. Kingsley:

On September

13,

1997, the

NRC completed

an inspection at your Browns Ferry

facility.

The enclosed

report presents

the results of that inspection'.

During the six-week period covered

by this inspection period, your conduct of

activities at the Browns Ferry facility was generally characterized

by safety

conscious

operations.

good engineering,

professionally conducted

maintenance,

and strong plant support.

Two violations of NRC requi rements

were identified.

NRC inspectors identified that snubbers

were being tested

under

conditions

other than those stated in th'e Technical Specifications

and that scaffolding

procedures

were not being correctly implemented.

The violation involving inadequate

implementation of scaffolding controls is

considered

a repetitive violation.

Repetitive violations are addressed

in the

NRC's "Statement of Policy and Procedure for NRC Enforcement Actions,"

(Enforcement Policy).

NUREG-1600,Section IV.B.

The Enforcement Policy allows

the severity level of a violation to be increased if the violation can be

~

considered repetitive.

For example,

a Severity Level

IV violation could be

increased

to Severity Level III with the attending escalated

enforcement

action.

However, in this case,

we have decided not to increase

the severity

level of this violation based

on the limited direct safety significance,

your

prompt initiation of corrective actions,

and your overall satisfactory

performance in this area.

The violations are cited in the enclosed

Notice of Violation (Notice),

and the

circumstances

surrounding the violations are described in detail in the

enclosed

report.

Please

note that you are required to respond to this letter

and should follow the instructions specified in the enclosed

Notice when

preparing your response.

The

NRC will use your

response,

in part. to

determine whether further enforcement

action is necessary

to ensure

compliance

with regulatory requirements.
