NOTICE OF ENFORCEMENT DISCRETION (NOED)

FOR TVA REGARDING BROWNS FERRY UNIT 2

[TAC NO. H91351]

Gentlemen:

By letter dated January 23, 1995, you requested that the NRC exercise discretion not to enforce compliance with the actions required in Technical Specification (TS) 3.9.B.3.

That letter documented information discussed with Hr. R. Hachon of your staff and Hr. J.

Johnson of the NRC in a telephone conversation on Jan'uary 23, 1995 at ll:00 am EST.

You stated that on January 23, 1995 at 8:05 pm CST the plant would not be in compliance with TS 3.9.B.3 which would require an orderly shutdown to cold shutdown within the next 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

TS 3.9.B.3 was entered at 8:05 pm CST on January 16, 1995 when Diesel Generator C experienced a failure of its turbocharger.

TS 3.9.B.3 states that when one of the units 1 and 2 diesel generators is INOPERABLE, continued REACTOR POWER OPERATION is permissible during the succeeding 7 days provided that 2 offsite power sources are available and all of the 'Core Spray, Residual Heat Removal

systems, and the remaining three units 1 and 2 diesel generators are OPERABLE.

You requested that a

NOED be issued and be effective for a period of 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> beyond the 7 day allowable outage time until January 26, 1995 at 8:05 pm CST.

Your letter stated that the Diesel Generator C turbocharger failure occurred during the performance of normal surveillance testing and was unforeseen.

Although the root cause of the failure has not yet been determined, you identified a previous failure of Diesel Generator 3A on August 25, 1992 which exhibited similar symptoms.

The failure of Diesel Generator 3A was due to a turbocharger planetary bearing failure which caused loss of concentricity in the planetary gear train and improper meshing of the gears.

You also discussed the repairs necessary to return Diesel Generator C to service which included receipt of parts and generator realignment and the estimated total time of 'up to ten days.

As discussed in the January 23 telephone call, the generator alignment was accomplished ahead of schedule, however an oil leak was discovered as a result of a problem with the replacement stubshaft bushing.

You provided as a safety rationale for the proposed action, a

description of the electrial system including the fact that there are three possible 4-kV supplies to each of the Unit I/2 shutdown boards following a loss of offsite power: the other shutdown bus, the associated diesel generator, and the Unit 3 diesel generator via a Unit 3 shutdown bus.

TVA also provided the results of a probabilistic risk assessment model which indicated an insignificant change in the core damage frequency.

You indicated that no additional compensatory measures where required.beyond those already in place for the Shutdown Board A battery modification as documented in your May ll, 1994 letter.

In a second telephone call between Hr. J. Johnson of my staff and Hr.

R.

Hachon of TVA on January 23,

1995, you were requested to, and agreed to provide
1) controls to assure that unnecessary maintenance activities are not initiated in the switchyard and 2) assurance that each operating crew reviewed your loss of offsite power abnormal procedures.

The staff considered that your proposal was acceptable and that the existing situation meets the NRC policy for enforcement discretion in that an unnecessary plant transient would result from this noncompliance with an action statement time limit.

This letter documents our telephone conversation on January 23, 1995 at 1:00 p.m.,

EST when we orally issued this notice of enforcement discretion.

On the basis of the staff's evaluation of your request, including the compensatory measures described

above, the staff has concluded that the exercise of enforcement discretion is warranted because we are clearly satisfied that this action involves minimal or no safety impact and has no adverse impact on public health and safety.

Therefore, it is our intention to exercise discretion'not to enforce compliance with TS 3.9.B.3 for the period from January 23, 1995 at 8:05 pm CST until January 26, 1995 at 8:05 pm CST for the reasons described herein.

However, as stated in Appendix C to 10 CFR Part 2, enforcement action will normally be taken, to the extent that violations were involved, for the root cause that led to the noncompliance for which this discretion was used.
