Dear Dr. Hurley:

Correspondence dated March ll, 1983 from the Commission concerning Amendment 51 (Docket No. 50-220) to Facility Operating License No. DPR-63 for the Nine Mile Point Nuclear Station Unit 81, requested that the Commission be kept informed about any changes in the Station's NPDES/SPDES Discharge Permit and any permit violations.

In accordance with these requirements, attached is a copy of the Station's new SPDES Discharge Permit dated July 1, 1983 issued by the New York State Department of Environmental Conservation. In addition, attached are copies of SPDES Discharge Permit violations since March of 1983. Although these incidents were technically violations of the Station's SPDES Discharge Permit, the New York State Department of Environmental Conservation considered these incidents non-violations under the circumstances. In all cases, either the particular permit limit had been modified and/or deleted (March, May, and June) or the particular violation was a result of natural algal growth.

Niagara Mohawk will fulfill the requirement to keep the Commission informed of any changes in the SPDES Discharge Permit or of any permit violations. Such information will be supplied to the Commission on a semi-annual basis in order to control manpower expense.
