Dear Mr. Vassallo:

Your order dated January 19, 1982 outlined the schedule for completing the Mark I long-term program at Nine Mile Point Unit 1. This program involves modifications which are needed to conform to the staff 's Acceptance Criteria contained in Appendix A to NUREG-0661. The order stated that the required completion date for plant modifications was "Prior to the start of Cycle 8 at the completion of your spring 1983 refueling outage".

As indicated in our letters of May 11 and August 6, 1982, Nine Mile Point Unit 1 was shut down in mid-Cycle 7 for the replacement of reactor recirculation system safe ends and piping. This unscheduled outage, which began in March of 1982, is not expected to be completed until summer 1983.

Upon completion of the outage, Cycle 7 operation will resume for approximately one year, at which time refueling will commence. Therefore, Cycle 8 will not commence until completion of the refueling outage now scheduled for 1984.

Based on the aforementioned, the completion of plant modifications needed to conform to the staff 's Acceptance Criteria will be at the completion of the 1984 refueling outage prior to the start of Cycle 8.
