I am writing in response to your inquiry dated February 28, 1990, to Mr. Dennis K. Rathbun, NRC Office of Governmental and Public Affairs, regarding a request for assistance from your constituent, Mr. David S.
Cook.
Mr. Cook seeks information on the amount of radiation exposure he might have received during an incident at the Nine Mile Point 2 reactor construction site in Oswego, New York.
The incident reportedly occurred in the fall of 1985; The incident described by Mr. Cook involved a radiography
- camera, a heavily shielded device that contains a small, intense sour ce of radiation.
By exposing this source, the device can be used to take X-ray like pictures of welds at a construction site.
The source is typically exposed for periods ranging from a few seconds to a few minutes to make these pictures.
During the time the source is exposed, the radiation levels near the device are high, but drop off rapidly as the distance from the source increases.
Possession of the source requires a license issued either by the Nuclear Regulatory Commission (NRC) or by an Agreement State.
An Agreement State is one that has entered into a formal agreement with the NRC to regulate certain radioactive materials, including radiography devices.
New York is an Agreement State.
In several telephone discussions between Mr. Cook, his lawyer and various NRC.
Region I personnel, it was explained that the NRC would not have a record of this event, since the State of New York has regulatory authority over the activity of concern.
The New York State licensee responsible for the radiographic activity was ITT Grinnell.
Mr. Cook was provided information to enable him to contact the appropriate New York State agency.
New York State personnel confirmed they had received a call from Mr. Cook.
He reportedly was informed that an investigation and report for an event four years ago must be requested in writing, and was requested to provide as many details as could be remembered.
When we contacted New York State on March 28, 1990, they indicated they had not received any written request from Mr. Cook.

'he Honorable Craig T. James Since the owner of the Nine Mile Point reactor and the host for the activity is an NRC licensee, Niagara Mohawk Power Corporation (NMPC), we have looked into the matter described by Mr. Cook.
We learned, from records maintained by NMPC, that an investigation was conducted by two Stone and Webster Engineering Corporation (SWEC) Safety Supervisors the day after the incident.
Based on documented interviews of Mr. Cook and a co-worker, and discussions with the radiographer, the Safety Supervisors concluded that no radiation exposure occurred because the radiographic source was in the shielded position when Mr.
Cook and his co-worker climbed down to the area adjacent to the radiography device.
The records did not address whether radiographic exposures were made during the one to two hour period the two individuals were in the general area.
The investigators concluded, however, that the area had not been adequately barricaded or monitored so as to preclude access to the general area where radiography was periodically being conducted.
Because the Nine Mile Point 2 reactor was not yet in operation at the time of the incident, and because Mr. Cook was not authorized or expected to enter areas where radioactive materials were present, he was not provided with radiation exposure dosimetry.
Hence, there are no exposure records for him.
Because we do not possess or have access to the records needed to make such an evaluation, we again recommend that Mr. Cook provide all the details he can recall to the State of New York and request that they provide him with an estimate of his exposure.
