In the Matter of Tennessee Valley Authority Docket Nos.
50-259 50-260 50-296 BROWNS FERRY NUCLEAR PLANT (BFN) UNITS 1, 2, AND 3 DETERMINATION OF NONREPORTABILITY In response to a violation in NRC Inspection Report 89-27, BFN has committed to advise NRC by letter in cases where it is determined through subsequent evaluation that a Licensee Event Report (LER) is not required to be submitted under 10 CFR 50.73 after an Emergency Notification System (ENS) report is made.
This commitment will serve to improve communications between BFN and NRC on those items which are conservatively reported but are later determined not to be reportable.

On December 22,
- 1989, a physical inventory at BFN identifi'ed a discrepancy between a special nuclear material (SNM) history record and the field installation location.

- 1989, NR" was notified of this event by the ENS as being reportable in accordance with 10 CFR 20.402(a) and 10 CFR 70.52.
10 CFR 50.402(b) requires each licensee who makes a report in accordance with 10 CFR 50.402(a) to make a report in accordance with 10 CFR 50.73 within 30 days if it is determined that there exists a
substantial hazard to persons in unrestricted areas due to loss of'NM.
Subsequent review of this event has determined that 10 CFR 20.402(a) does not apply since there is no evidence or indication that any SNM w
s ever located in an unrestricted area or that a hazard exists in any unrestricted area.
Therefore, the 30-day report in accordance with 10 CFR 20.40?(b) will not be made.
This event was reportable under 10 CFR 70.52 and no additional reports are required by this regulation.
