CONFIRMATORY ORDER:

EA 84-54 (REFERENCE REPORT NOS. 50-259/84-02, 50-260/84-02, 50"296/84-02, 50-259/83-60, 50-260/83-60, AND 50-296/83-60)

Based on the results of NRC inspection activities and the enforcement history of the Browns Ferry Plant, we conclude that the Tennessee Valley Authority (TVA) has not given sufficient management attention to assuring adherence to regulatory requirements.

The Region II Admi ni strator expressed his concerns with the recurring violations at Browns Ferry and your failure to prevent the violations during an Enforcement Conference in the Region II Office on February 24, 1984.

In addition, the Regional Administrator identified areas.

of special and immediate concern.

These are the lack of effective communication between operating personnel and other organizational units of TVA and the ineffective application of resources at operating units.

These and other concerns identified at that meeting are typical of those expressed to TVA management during calendar year 1983 when there were six enforcement conferences and four management meetings.

Apart from decisions as to the any other enforcement actions to be taken on recently identified violations of NRC requirements, we believe that positive and expeditious completion of those initiatives which you described in your Browns Ferry Regulatory Performance Improvement Program and the organizational changes within TVA described in your letter dated May 4, 1984 are both necessary and appropriate to the continued safe operation of the Browns Ferry Plant.

Therefore, a Confirmatory Order, effective immediately, is enclosed to confirm your commitments, including their. completion dates.

This action is being taken to assure the implementation of your commitments on a schedule that is both capable of being implemented by TVA and commensurate with their safety significance.

The responses directed by the enclosed Order are not subject to the clearance procedures of the Office of Management and Budget, as specified by the Paperwork Reduction Act of 1980, PL 96-511.
