A special inspection was conducted by Mr. T.
R. Collins of this office on October 25, 1982, of activities authorized by NRC Operating License Nos.
DPR-33, DPR-52, and DPR-68 for the Browns Ferry facility.
The purpose of the inspection was to determine the circumstances surrounding violations of NRC requirements which occurred during shipments of radioactive waste from the Browns Ferry facility to a disposal site in the State of Washington during September and October 1982.
The inspection findings revealed three failures to meet the requirements of 10 CFR Part 71 for the shipment of radioactive material.
These findings were discussed with Browns Ferry facility management on October 25, 1982.
The violations related to two shipments of low specific activity radioactive waste.
In one, eight drums had defective closure devices.
In the other, four drums had unsecured
- gaskets, and one drum had been pierced, apparently by fork-liftblades.
TVA has recently been cited for another transportation violation.
In an inspec-tion conducted on August 25, 1982 (Inspection Report Nos. 50/259/82-26, 50-260/
82-26, and 50-296/82-26, transmitted by NRC letter dated November 3, 1982),
it was determined that the integrity of a 55-gallon drum in one shipment was breached due to a chemical reaction with the metal of the drum, and in another
- shipment, eight wooden containers arrived. at the burial site in Richland, Washington without proper markings to indicate their contents.
The findings of these inspections indicate significant problems regarding control of shipments of radioactive materials from the Browns Ferry facility. Accord-
- ingly, NRC Region II met with TVA management officials at Region II on November 5, 1982 to discuss their concerns.
TVA management officials described those steps it had taken or planned to take to ensure'hat future shipments will be in accord with regulatory requirements.

Tennessee Val 1 ey Authority Deq~bep l7, 3.982 After consultation with the Director of the Office of Inspection and Enforcement, I have been authorized to issue the enclosed Notice of Violation and Proposed Imposition of Civil Penalty in the cumulative amount of Three Thousand One Hundred and Twenty-Five Dollars to emphasize the need for the Tennessee Valley Authority to ensure that procedures affecting packaging and transport of radio-active materials are meticulously followed.
The violation for which this penalty is proposed has been categorized as Severity Level III as described in the NRC Enforcement Policy (10 CFR Part 2, Appendix C, 47 FR 9987, March 9, 1982).
The base civil penalty of $2,500 was increased by 25% because multiple examples of the violation were identified during the inspection period and these self-disclosing violations were not initially discovered by the licensee.
You are required to respond to the Notice and should follow the instructions specified therein when preparing your response.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"
Part 2,
Title 10, Code of Federal Regulations, a copy of this letter and the enclosure will be placed in the NRC's Public Document Room.
The responses directed by this letter and the enclosure are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
