A special inspection was conducted by NRC Region II on February 23, 1982 at the Browns Ferry Nuclear Plant to evaluate the regulatory significance of a vital area barrier penetration discovered by the NRC Resident Inspector on February 18, 1982.

The inspection revealed an apparent violation of NRC regulatory requirements; the violation is presented in the Notice of Violation and Proposed Imposition of Civil Penalty enclosed as an Appendix to this letter.

The NRC inspector described 'th'is.violation.in a meeting with the Plant Superintendent at the conclusion of the inspection.

This violation and t

related NRC concerns were further discussed during an Enforcement Conference held in the Region II Office in Atlanta on March 9, 1982.

This violation is similar to others identified in Region II inspections con-ducted in November 1980 and June 1981.

Considered collectively, these viola-tions indicate a failure, on the part of TVA, to seek out and remedy basic causes of violations and a tendency to react to specific NRC findings, rather than to take the initiative in identifying potential problems.

More effective corrective action in response to the November 1980 violation might have prevented the similar violations identified by NRC inspectors in June 1981 and February 1982.

In order to emphasize the need for controlling access to vital areas, the Nuclear Regulatory Commission proposes to impose a civil penalty in the amount of Fifty Thousand Dollars for the item identified in the enclosed Notice of Viola-tion and Proposed Imposition of Civil Penalty which has been categorized at the Severity Level described in accordance with the NRC Enforcement Policy published in the Federal

The base penalty of Forty Thousand DDo Dars was increased bv twenty-five percent as provided by the policy because you could reasonably have been expected to have taken preven-tive measures.

In your reply you should give particular attention to those actions designed to increase the effectiveness of the management of your security program in order to ensure continuing compliance with NRC requirements in this area.

Your reply to the Appendix and the results of future inspections will be considered in determining whether further enforcement action is appropriate.

The text of the enclosed Appendix contains Safeguards Information as defined

.by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended.

Therefore, the Appendix will not be placed in the NRC Public Document Room.

The response directed by this letter and the enclosure are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
