This refers to your letter of April 3, 1981, in response to the Notice of Violation and Proposed Imposition of Civil Penalties and Notice of Deviation sent to you with our letter of March 20, 1981 concerning enforcement matters identified during the January 6-9 and 20-23, 1981 inspection of the Browns Ferry Plant by the NRC Region II Office.
Your prompt response to our letter of March 20 and the proposed corrective action indicates that TVA is making a concerted effort to correct deficiencies'n the fire protection program.
However, after careful consideration of your
- response, we have concluded that, with the exception of Item C, the violations occurred as stated in the Notice of Violation and Proposed Imposition of Civil Penalties.
Me have also concluded for the reasons stated in Enclosure 2 that the deviations occurred as stated in the Notice of Deviation.
Therefore, civil penalties proposed in the Notice of Violation and Proposed Imposition of Civil Penalties should be imposed with the following exception.
After consideration of your response to Item C, the NRC has withdrawn the violation and its proposed civil penalty.
The results of future inspections, including implementation of corrective actions described in your April 3 letter, will be considered in determining whether further enforcement action is appropriate.
