The Browns Ferry Unit Number 3 facility was operated on December 6 to 9, 1979, without primary containment integrity.

This matter was discussed by telephone on December ll and 20, 1979 with Mr. J.

R. Calhoun, Director of Division of Nuclear Power, by Mr. James P. O'Reilly, Director of our Region II office and Mr. F. J.

Long.

The results of these conversations and our under-standing of your planned corrective actions were described in letters to you from Mr. O'Reilly and Mr. Long dated December 12 and 21, 1979.

These initial corrective actions were confirmed by our onsite inspection personnel.

The violation of'ontainment integrity is a matter of safety significance which demonstrates a weakness in your ability to control licensed activities, specifically, your ability to control routine maintenance activities.

There-fore, we propose to impose civil penalties for the items of noncompliance set forth in Appendix A to this letter in a total amount of $29,000.00.

Appendix B

of this letter is a Notice of Proposed Imposition of Civil Penalties.

You are required to respond to this letter; in preparing your response you should follow the instructions in Appendices A and B.

In addition to the Proposed Civil Penalties, we are issuing the enclosed Order (Appendix C) applicable to all units at the Browns Fe} ry facility effective immediately to require that appropriate review of administrative. controls and procedures for maintenance activities, including procedures for removal and replacement of containment penetration closures be performed to assure that the limiting conditions for operation of the facility Technical Specifications (TS) are not defeated by maintenance or oth'er activities.

Also, an appropriate review of your reporting requirements shall be conducted to assure that they are consistent with regulatory requirements.

The Order further requires that a report of your corrective actions be submitted by January 15, 1980, to the Director of NRC's Region II office and that you meet with Office of Inspection and Enforcement management on or before January 21, 1980, at a location in the vicinity of the Browns Ferry site to describe how your corrective actions will be implemented.

Details relating to this meeting will be arranged by the Region II Director.
