1) of a requested amendment to licenses DPR-33, DPR-52, and DPR-68 to change the provisions of the subject licenses, dealing with nuclear material.

Also enclosed are 40 copies of justifications and reasons for the proposed amendment (Enclosure 2).

In order to not affect the refueling outage schedule for unit 2 this spring, we would appreciate

'our expeditious consideration of this matter.

In accordance with the requirements of 10 CFR Part 170.22, we have determined this proposed amendment to be Class II for unit 1 and Class I for units 2

and 3.

These classifications are based on the facts that the proposed amendment is an admgnistrative change that has no safety or environmental

significance for unit 1, and the proposed amendments for units 2 and 3 are duplicates of the unit 1 proposed amendment.

The remittance for $2,000

($ 1,200 for unit 1 and

$800 for units 2 and 3) is being wired to the NRC, Attention:

The ownership,

receipt, possession,
use, anc transfer or" source, byproduct, and special nuclear mater'al as authorized by this license will be in accordance w'th the Commission's regulations in 10 CFR Parts 30, 40, and 70, including 10 CFR Sections 30'.33, 40.32, 70.23, a'nd 70.31; Section 2.B.(2):

Pursuant to the Act and 10 CFR Parts 40 and 70, to acquire,

receive, possess,
use, transfer, and package for transport at any time source and special nuclear material as reactor fuel in accordance with the limitations for storage and amounts required for reactor qperation, as described in the'inal safety analysis, report as supplemented and amended; Section 2.B. (3):

Pursuant to the Act and.10 CFR Parts 30, 40, and 70, to

acquire, receive,
possess, use, and transfer at any time any byproduct,
source, and special nuclear material as sealed neutron sources for reactor startup, sealed sources for reactor instrumentation and radiation monitoring equip-ment calibration, and as fission detectors in amounts as

Pursuant to the Act and 10 CFR Parts 30, 40, and 70, to

acquire, receive,
possess, use, and transfer 'in amounts as required any byproduct,
source, or. special nuclear

. material without restriction to chemical or physical form for sample analysis or equipment and instrument calibration or associated with radioactive apparatus or components;

There exists now and vill continue to exist a periodic need to transfer nuc'ear materials from Browns rerry Nuclear Plant.

As an example, unirradiated fuel assembl'ies vhich are detected as being damaged or not within specifications during onsite receiving inspection, may require return to tne supplier's fuel fabrication facility for rework or repair.

Provisions to permit these and other types of transfers (specifically

'permitting packaging for delivery to a carrier) vere contained in tht;.

special nuclear material licenses for Brooms Ferry units 1,

2, and 3

(SXA1268, Siiill434, SNH1511) but were omitted from the operating licenses upon their issuance.

4 TVA was. informed on ';larch 8,

1979, by the, General Electric Company that fuel bundle LJ8179 (an 8 x 8 fuel assembly) conta'ns one fuel rod from rod lot DWZ02 which experienced some failures at Vermont Yankee.

This fuel bundle is scheduled for core insertion during the upcoming Browns Ferry unit 2 spring refueling outage.

General Electric has arranged for bundle transportation from Browns Ferry to Wilmington, North Carolina, and back to Browns Ferry.

The cladding for the subject fuel rod will be replaced at Wilmington.

Even though General Electric and the transport carrier are fully $icensed to receive and transport the fuel bundle, the..

Browns Ferry operating license does not specifically give TVA the authority to transfer the fuel bundle.

Therefore, TVA needs approval of this proposal no later than >farch 23, 1979, in order that the refueling outage activities for Browns Perry unit 2 are not affected.

TVA has considered three alternatives to solve this problem.

Those alternatives consist of the following.

General Electric'might transport a single fuel rod to the Browns Ferry site and reconstitute the fuei bundle onsite:-

However, this process could take several months to complete because of'he unavailability of replacement fuel pellets.

TVA also tried to arrange

for, p'urchase of another 8 x 8 fuel assembly from General Electric, but General.

Electric no longer manufactures 8 x 8 fuel assemblies of a design similar to LJ8179.

Therefore, the only alternative that is viable seems to be changing the operating license to specifically state that TVA can.transfer fuel.
