ENCLOSURE NOTICE OF VIOLATION Carolina Power and Light Company Shearon Harris Nuclear Plant Unit 1 Docket No. 50-400 License No.

NPF-63 EA 90-010 During the Nuclear Regulatory Commission (NRC) inspection conducted on December 26, 1989 - January 5,

1990, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1989), the violation is listed below:

Technical Specification (TS) 3.3. 1 requires the Reactor Trip System Instrumentation of Power

Range, Neutron Flux, High and Low Setpoints, and the High Negative and Positive Rate Trips be operable in Modes 1 and 2.

TS 2.2. 1 requires the Reactor Trip System Instrumentation setpoints to be set consistent with the trip setpoint values shown in Table 2.2-1.

Table 2.2. 1, in part, lists the power range setpoints as shown below.

Low Setpoint

< 25K of RTP c.

High Positive Rate

< 5X of RTP d.

High Negative Rate

< 5X of RTP TS 3.7. 1 requires that the Power Range Neutron Flux High Setpoint be lowered to < 87K of RTP for an inoperable main steam safety valve.

Contrary to the

above, at approximately 3:23 a.m.

on December 20, 1989, when the plant entered Mode 2 with an inoperable main steam safety valve, until approximately 3:30 a.m.

on December 23, 1989, when the power range instrument adjustments were completed, the Reactor Trip System Instrumentation setpoints were not set consistent with the trip values shown in Table 2.2-1 and TS 3.7-1.

Actual established Reactor Trip setpoints were calculated to be the following for the Power Range Neutron Flux:

a.

High Setpoint 127.5X of Rated Thermal Power (RTP) b.

Low Setpoint 37.5X of RTP c.

High Positive Rate 7.5X of RTP d.

High Negative Rate

7. 5X of RTP This is a Severity Level IY violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

NPF-63 EA 90-010 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results

achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is

shown, consideration will be given to extending the response time.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other 'action as may be proper should not be taken.
